Candidate Privacy & Confidentiality Terms

Infinite Academics and its affiliates (“Infinite Academics,” “we,” “us,” or “our”) collect and use certain personal information about job and contractor candidates during our recruiting and hiring process (the “Process”). By submitting an application or participating in the Process, you acknowledge that you have read and understand this Notice and agree to the confidentiality terms below. If you do not agree, do not proceed with your application.

1. Personal Information We Collect

We may collect, store, and use the following categories of information about you:
Contact details: name, email, phone number, mailing address, location.

  • Application details: résumé/CV, cover letter, work history, education history, licenses/certifications, skills, compensation expectations, and any other information you choose to provide in forms, calls, or messages.
  • Assessment information: interview notes, work samples, references, and assessment or test results (where permitted by law).
  • Technical / usage data: IP address, device and browser type, and limited usage data when you visit our sites or application portals (including via cookies or similar tools).

We obtain this information primarily from you, and where lawful, from third parties such as recruiters, references, background-check providers, and assessment vendors.

 

2. How We Use Your Information

We use your information to:

  • review and manage your application and evaluate your suitability for current and future roles;
  • communicate with you about the Process and related opportunities;
  • conduct interviews, assessments, and reference/background checks (where lawful);
  • maintain records of our recruiting activities and decisions;
    improve our recruiting processes and candidate experience; and comply with legal, regulatory, and corporate requirements, and protect our rights, systems, students, and personnel.

We retain candidate information only as long as reasonably necessary for these purposes and to meet legal and recordkeeping obligations.

 

3. How We Share Your Information

We may share your information with:

  • Affiliates involved in the Process or considering you for roles;
  • Service providers that support our recruiting and HR operations (for example, applicant tracking systems, background-check providers, assessment vendors, IT and cloud services) under confidentiality and data protection obligations;
  • Professional advisors (for example, legal, audit, consulting) where reasonably necessary; and Authorities or other third parties when required or permitted by law, or in connection with corporate transactions (for example, mergers, acquisitions, financings, or reorganizations).
We do not sell your personal information for monetary consideration.
 

4. Your Rights and Choices

Depending on your location, you may have rights to:

  • request access to or a copy of your personal information;
  • request correction or deletion of your information;
  • object to or request restriction of certain processing; orwithdraw consent where processing is based on consent.

5. Security

We use reasonable technical and organizational measures intended to protect your personal information from unauthorized access, loss, or misuse. However, no system or transmission over the internet is completely secure, and we cannot guarantee absolute security.

6. Candidate Confidentiality Obligations

During the Process, you may receive or access non-public information about Infinite Academics and its affiliates.


6.1 What Is “Confidential Information”
“Confidential Information” means any non-public, confidential, or proprietary information, in any form (oral, written, visual, electronic, or otherwise), relating in any way to Infinite Academics and/or its owners, officers, directors, employees, contractors, students, families, partners, suppliers, advisors, investors, and other business associates, and any of their successors or assigns (collectively, the “Company Parties”). This includes, without limitation:

  • business concepts and ideas;
  • technical and non-technical information about current, future, and proposed products and services;
  • curriculum, lesson plans, educational content, methodologies, and delivery approaches;
  • information concerning research, development, designs, specifications, and processes;
  • pricing, margins, forecasts, financial information, and budgeting;
  • student, family, customer, and prospect information, including lists, contact details, and engagement history;
  • vendor, partner, and supplier information and terms;
  • marketing plans, strategies, campaigns, funnels, offers, and performance data;
    software, tools, source code, object code, system architecture, and configuration information;
  • trade secrets, know-how, and other intellectual property;
    business strategies, operating methods, SOPs, playbooks, internal documentation, and training materials;
  • and any other information that is not generally available to the public and that a reasonable person would understand to be confidential or proprietary.

Confidential Information also includes, without limitation:
(a) the names, likenesses, voices, and personal or professional details of any owners, executives, or other Company Parties where not publicly disclosed by Infinite Academics; and
(b) the existence and nature of any relationship, discussions, interviews, offers, or other interactions between you and any Company Party, including these Terms and your participation in the Process.
Information will not be considered Confidential Information to the extent you can demonstrate that it: (i) is or becomes publicly available through no act or omission by you; or (ii) is rightfully received from a third party without a duty of confidentiality.
All Confidential Information is and shall remain the exclusive property of the Company Parties. You receive no license or rights to our intellectual property beyond what is necessary to participate in the Process.

 

6.2 Your Obligations

You agree that you:

  • will use Confidential Information solely to evaluate and, if applicable, perform in connection with a role at Infinite Academics;
  • will not disclose Confidential Information to any third party without our prior written consent;
  • will take reasonable steps to protect Confidential Information and prevent unauthorized use, access, or disclosure;
  • and upon request, or when your candidacy or any engagement ends (whether or not you are hired), will promptly delete, destroy, or return (as instructed) all Confidential Information in your possession or control, including copies and derivatives.

These confidentiality obligations begin when you first receive Confidential Information and continue indefinitely, even if you are not hired or if any later engagement ends.
You acknowledge that the Confidential Information has been developed at significant expense and constitutes valuable proprietary information and/or intellectual property of the Company Parties. You further agree that monetary damages alone may be inadequate to compensate the Company Parties for a breach or threatened breach of these obligations. Accordingly, Infinite Academics shall be entitled to seek injunctive or other equitable relief, in addition to any other remedies available at law or in equity, without the need to prove actual damages or post bond.
